I was arrested yesterday for being drunk inside the ground yesterday & have to go to court on the 29th, seems like I may be heading for a banning order.

Any advice?

You can be found to be drunk just on a police officers say so without any other evidence - there is also no defense since the police officers' word is taken as truth. Could they have been mistaken?

Banning orders are however only supposed to be issued for violent behaviour and your legal advisor should make sure the magistrate is aware of that.

The FSF can put you in touch with an experienced lawyer if you think you're going to need one.

Claim you had a littly amount to drink, say 6 pints or so and you must have been spicked? Not sure it would work mind but its worth a shot.

James - April 13, 2008 03:46 PM (GMT)
ask to see CCTV footage. If you were drunk and creating a nusence then it should show up on there..if it doesn't then it may be in your favour.

Peter SUSD - April 13, 2008 04:17 PM (GMT)
Must get a good lawyer.

It may even be worth pleading guilty to being drunk if that gets you off a ban, but only experienced lawyer coudl tell you that.

BWA_Ultra - April 13, 2008 05:31 PM (GMT)
I was drunk yes, despite not really drinking that much. I was not causing a nuisance at all however.

It is a good job they don't arrest everybody who is drunk in town/city centres on a friday/saturday night.

Or even everyone who is drunk at a football match!

red_rose - April 13, 2008 07:34 PM (GMT)
Pretty weird because I was arrested at reading the other week for exactly the same thing but only cautioned.
I think you'll be ok, I know a few people who have been charged but not banned.

stretford ender - April 13, 2008 07:51 PM (GMT)
TO get banned for being drunk at a football match would be the most pathetic thing ive ever heard. How could you ban somebody for that?

Good luck anyway mate.

I guess the difference may be that I am well known to police in Essex & the club seem to want me banned(rightly or wrongly) so if there is any subjective leeway in this it will go against me.

I have no issues with being locked up for 7 hours but to go to court to face a punishment that is intended for violent hooligans I think is crazy.

Thanks for the good messages people, it is great having a forum which despite our minor disagreements have likeminded fans all standing up for the same cause.

LH_88 - April 14, 2008 09:34 AM (GMT)
What did they do? Just approach you and say 'You are drunk, get out'. Or were you actually causing a nuisance whilst being drunk? If it was the former, I don't see what the problem is with just having a few beers

At Newcastle away 3 seasons back - some lad was so drunk his legs literally wouldn't work and the stewards were laughing as his mates tried to drag him up about 50 flights of steps! No problems whatsoever.

Hodgson - April 14, 2008 09:59 AM (GMT)
My mate got arrested last week for taking a hip flask into the ground. Had to go back to court on thursday. He said he was facing a banning order, but the lawyer got him off with a £100 fine including court costs. In court the lawyer kept putting it back on the stewards. Good luck.

I wasn't causing a nuisance, was a bit too drunk to function let alone cause a problem. They could have just put me on a seat and I would have probably just sat and watched the game. I think I am more mellow when I am pissed.

When we played Accrington away in the FA Cup a few years ago a guy was so drunk he just leant over a barrier and fell asleep for half the games.

albiontilidie - April 14, 2008 11:22 AM (GMT)
good luck mate hope it goes well for you

leicester police are a joke and caused a lot of problem with our fans, chcuked us all out the pub and frog marched us down to the ground,

someone @coventy away this year in league was so drunk he got to the back seats and slept on a few the whole game nothing was said by polive

john_lcfc - April 18, 2008 04:17 PM (GMT)
our police are arses.

BWA_Ultra - April 19, 2008 09:14 AM (GMT)
We had 4 or 5 lads nicked @ Norwich couple of weeks back, for taking beer in the ground & another was for drunk and disorderly

AFAIK they only got warnings, how is being drunk but not disorderly worse?

BWA_Ultra - April 19, 2008 05:11 PM (GMT)
I received a letter from the club saying I am banned until April 2010

BWA_Ultra - April 19, 2008 05:42 PM (GMT)
Unfortunately from Colchester mate.

Amanda - April 19, 2008 08:24 PM (GMT)
BWA - email me at ajm22769@yahoo.co.uk with the story behind your arrest, whether or not you're going to be prosecuted, etc, etc.

As much detail as possible please. We'll see what we can do to help.

jesus! fight it to the death - you've got nothing to lose now.

good luck!

purpleronnie - April 20, 2008 11:54 AM (GMT)
You're drunk at an away game and you get banned for 2 years from home games? Thats astonishing.

BWA_Ultra - April 20, 2008 05:52 PM (GMT)
Amanda-I will e-mail on monday, thankyou.

So far I have been banned from home games only until april 2010 including our farewell to layer road next week. After 10 years of going non-stop this is a huge kick in the teeth.

purpleronnie - April 21, 2008 11:02 AM (GMT)
The way fans are treated in england never fails to amaze me. The problem is 99% couldn't give a tench and accept it.

BWA_Ultra - April 21, 2008 01:10 PM (GMT)
Amanda, I have gathered all the information together and have sent you an e-mail

thnaks

Lee

Lawnmower Man - April 21, 2008 10:33 PM (GMT)
Jesus tittyf*cking Christ!

Good luck with fighting it.

BWA_Ultra - April 22, 2008 08:42 AM (GMT)
There's only 1 home game that matters to me and that is saturday (last ever layer road game), I very much doubt that there's anyway that I can attend this game.

I want to fight it out of principle though even if I don't want to go to home games next season.

If I am given a FBO next tuesday then it makes this ban immaterial except that I would have missed the last 2 games at our old ground!

AFC#1 - April 22, 2008 12:19 PM (GMT)
All the best with your fight.
Pretty shocking that because of having a couple too many maybe and a jobsworth copper, that you are now banned for 2 years!!

fozzt - April 22, 2008 12:44 PM (GMT)
So, your club has banned you;

Before this has gone to Court?

Before any type of meeting with the club?

I'd ask you for details of the incident, but I think you should keep them off the forum for now.

Good luck with your fight, I think you've been treated disgracefully.

BWA_Ultra - April 22, 2008 12:48 PM (GMT)
Yep!

Yep!

probably should!

BWA_Ultra - April 22, 2008 04:06 PM (GMT)
As I have a season ticket aswell as missing 4 games this season I have lost out financially.

I have asked for a refund on games that I have been banned for but I have been refused, anybody aware of any rules regarding this?

If I purchased match to match I would have been better off this season.

BWA_Ultra - April 30, 2008 09:24 AM (GMT)
No football banning order, just a fine.

Could have been worse, I guess.

still think the whole process was a waste of everybody's time and money.

Must have been a really slow news day. You got the same fine for just being drunk, crazy.

I think they can print your name, freedom of the press.

BWA_Ultra - May 1, 2008 12:48 PM (GMT)
carps, it may not exactly be secret but to type your name, road & town.

Are all the guys in Essex called Lee?
